Online Casino Rules for Visitors and Expats in Poland
Polish gambling law applies to everyone who takes part from Poland, whatever their nationality. If you are visiting, studying or working here, a casino account that is legal in your home country can still be illegal to use while you are in Poland.
Gambling is for adults aged 18 and over. It can lead to addiction and financial harm. Taking part in illegal online gambling in Poland can lead to a fine equal to your winnings.
Your home-country casino account while you are in Poland

Many visitors assume that an account opened legally at home, for example with a casino licensed in the UK, another EU country or elsewhere, can be used anywhere. Polish law does not work that way.
- Online casino games in Poland are reserved to the state monopoly, and foreign licences are not recognised (Gambling Act, art. 5(1b)).
- Taking part in online gambling offered without a Polish permit is prohibited (art. 29a(2)).
- The Fiscal Penal Code makes it an offence for anyone “on the territory of the Republic of Poland” (na terytorium Rzeczypospolitej Polskiej) to take part in a foreign gambling game (art. 107 §2). The law makes no exception for accounts opened abroad or for licences that are valid in your home country.
Many international gambling websites are also on Poland's register of blocked gambling websites, so they may not load from a Polish internet connection. The penalties for players apply whether or not a website is blocked. This page gives general information; if you need advice about your own situation, speak to a lawyer.
Age and identity rules
- 18 and over only. Only adults may take part in gambling in Poland, apart from promotional lotteries and raffles (Gambling Act, art. 27(2)).
- Registration and age checks. A legal online gambling operator must check that you are 18 or over and require you to register a player account before you play (art. 15i).
- Anti-money-laundering checks. Gambling operators must check customers' identity when they start a business relationship, such as opening an account, and for stakes or winnings of €2,000 or more, whether in one transaction or several linked ones (Anti-Money Laundering Act, art. 35(1)).
- Records of larger wins. Operators must record winnings of 2,280 zł or more with the winner's name, identity document and PESEL number, or, for someone without a PESEL number, their address, date of birth and citizenship (Gambling Act, art. 20(5) and (7)).
Account requirements, such as which identity documents are accepted, are set in each legal operator's approved rules.
Tax on winnings if you live in Poland or are visiting
Winnings from slot, card, roulette-type and dice games run by an authorised operator under the gambling law of an EU or EEA country are exempt from Polish personal income tax. Winnings from lotteries, number games and betting are exempt only up to 2,280 zł per win (Personal Income Tax Act, art. 21(1)(6a)). Where and how you are taxed can also depend on your tax residence, so check your own position before relying on an exemption.
